Changes to the Off-Payroll Working Rules
The Off-Payroll Working Rules consultation aims to address double taxation issues by HMRC. If errors are found in applying the rules, the deemed employer may need to pay the correct Income Tax and National Insurance Contributions. Workers can claim repayment for overpaid taxes if errors are discovered after tax returns are filed. HMRC is considering allowing set-off of taxes already paid by workers against a deemed employer's PAYE liability. Assumptions and best judgment will be used to estimate taxes paid on off-payroll income. Workers and intermediaries can appeal direction notices within 30 days.
